December 29, 2006, Newsletter Issue #44: Legal Advice

Tip of the Week

Base Area Defense Counsel offices and other organizations like it are designed to help people regardless of their military rank in matters such as powers of attorney, last wills and testament, and help in the event of legal procedings such as a court-martial. Some people assume that they can also get help in divorce proceedings and child custody cases. Unfortunately, that is outside the charter of a military lawer--they are forbidden from giving advice in areas that fall outside the mission of the military legal system.

Your best bet is to hire a civilian lawyer and try to resolve your situation quickly. Keep in mind that you are entitled to use a military lawyer to defend you in situations where you may be wrongfully accused of domestic violence, neglect or other 'actionable' issuse where your military chain of command gets involved. Your military rank may depend on the successful resolution of issues such as these--don't pass up the free help of a military lawyer.
